Coaching Terms

These terms apply to all paid 1:1 coaching services by Nadine Kühn, Wühlischstraße 31, 10245 Berlin, Germany (Imprint), booked through this website. They apply together with the Terms & Conditions of the website and the Privacy Policy.
1. Services
I offer 1:1 coaching in packages (single session, 3-session package, 3-month package and 6-month package). Which package you book, what it includes and the price are shown on the Work With Me page and confirmed to you before you pay. Every package starts with a free 20-minute introductory call, which does not oblige you to book.
Sessions take place online by video call (Zoom). Each session is individually tailored to you. The first session and a single session last about 90 minutes. Further sessions of a package last about 60 minutes.
2. Contract
The contract is made when you book a package and I confirm your booking by email, or when you complete the booking and payment process. The contract language is English.
3. Prices and payment
All prices are in euros and include statutory VAT. You can pay by Stripe (credit card), PayPal or bank transfer. Bank transfer is available for customers in Germany and Europe.
Payment in installments. If we agree on a payment plan, the total price stays the same and is paid in the agreed installments. If an installment is more than 14 days overdue after a reminder, I may pause further sessions until the amount is paid. The remaining installments stay due.
Sessions start once the full price has been paid or, if we agree on a payment plan, once the first installment has been received.
4. Scheduling, rescheduling and cancelling a session
We agree on session dates together. You can reschedule or cancel a session free of charge up to 48 hours before it starts. If you cancel later or do not show up, the session counts as held, unless the reason lies with me or we agree otherwise. If I have to cancel, I will offer you a new date.
Sessions of a package must be used within the package period (3-session package: 4 weeks from the first session; 3-month package: 3 months; 6-month package: 6 months). The programs are designed to reach a specific goal within this time, which requires your commitment. Unused sessions expire after this period without refund, unless I could not offer a date.
5. Right of withdrawal for consumers
If you are a consumer, you have a statutory right of withdrawal. The notice below explains it.
Withdrawal notice
Right of withdrawal. You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day of the conclusion of the contract.
To exercise your right of withdrawal, you must inform me (Nadine Kühn, Wühlischstraße 31, 10245 Berlin, Germany, email: info@shehealsher.com) of your decision to withdraw from this contract by a clear statement (for example a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory. To meet the withdrawal deadline, it is sufficient that you send your communication before the withdrawal period has expired.
Effects of withdrawal. If you withdraw from this contract, I will reimburse all payments I have received from you without undue delay and no later than 14 days from the day on which I receive your notice of withdrawal. I will use the same means of payment as you used for the original transaction, unless we expressly agree otherwise. You will not be charged any fees for the reimbursement.
If you asked me to begin the services during the withdrawal period, you must pay me an appropriate amount. It corresponds to the share of the services already provided up to the time you inform me of the withdrawal, compared with the full scope of the services in the contract.
Early expiry of the right of withdrawal. The right of withdrawal expires early if I have fully provided the service and began providing it only after you gave your express consent and confirmed that you know you lose your right of withdrawal once I have fully performed the contract.

6. Refunds beyond the right of withdrawal
Beyond your statutory rights, there is no general refund. If coaching turns out not to be right for you, tell me in writing. In exceptional cases I may, at my discretion, agree on a partial refund of sessions not yet held. There is no legal claim to this, and sessions already held are not refunded.
7. What coaching is and is not
Coaching supports you in your own process. It is not psychotherapy, medical treatment, diagnosis or legal advice, and it does not replace any of these. I do not promise a specific result or healing. Your decisions and actions remain your own responsibility. If you are in acute crisis or have thoughts of harming yourself, please contact a doctor, therapist or local emergency services right away. I am not an emergency service.
8. Confidentiality and recordings
What you share in sessions stays confidential, unless the law requires otherwise or someone is in acute danger. Please do not record sessions without prior written agreement from both of us. How I handle your personal data is described in the Privacy Policy.
9. Liability
I am fully liable for intent and gross negligence, for injury to life, body or health, and wherever the law makes liability mandatory. For slight negligence I am only liable for breach of essential contractual obligations (obligations whose fulfilment makes the proper performance of the contract possible in the first place and on which you can regularly rely), and then limited to the foreseeable damage typical for this kind of contract. Otherwise liability is excluded. Your statutory rights as a consumer remain unaffected.
10. Governing law and disputes
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you keep the mandatory consumer protection rules of the country where you live. I am not willing or obliged to take part in dispute resolution proceedings before a consumer arbitration board.
11. Changes and severability
For a booked package, the terms valid at the time of booking apply. If a provision is or becomes invalid, the rest stays in force.
